Terms of Use
Effective October 13, 2026
These terms are an agreement between you and Jason Meller, the individual who operates Maimbrain ("we", "us"). They cover the Maimbrain website, the iPhone app, the mb command-line tool's connection to Maimbrain, and everything you can do with them ("Maimbrain"). You agree to these terms and to our Privacy Policy by tapping "I agree" when you create an account, and by using Maimbrain. If you don't agree, don't use Maimbrain. If a company is formed to run Maimbrain, it will take over these terms.
Who can use Maimbrain
During the beta you must be 18 or older to create an account, and you'll be asked for your birthdate when you do. Once Maimbrain is publicly released, you'll need to be at least 13 years old, and in the European Economic Area or the UK at least 16 or have a parent or guardian's consent; if you're under 18 then, a parent or guardian must agree to these terms for you. You can't use Maimbrain if we've banned you, or if the law forbids you from using it.
It's a beta
Maimbrain is early and changing fast. Features may change or disappear, things may break, and data (including games, scores and accounts) may be lost. We may limit, change or stop Maimbrain, or any part of it, at any time.
Your account
Give us accurate information, keep your sign-in secure, and don't share your account. You're responsible for what happens under it. Tell us at privacy@maimbrain.com if you think someone else is using it. Don't pick a username that impersonates someone or infringes someone else's rights; we may reclaim usernames.
Invites
For now Maimbrain is invite-only: you need a member's invite to create an account. Each member has a personal invite link with a limited number of invites, and one is used up whenever someone signs up with it. We may give you more invites, or take away ones you have, at any time. Don't sell or trade invites, post them to spam people, or use them to get around a ban.
What you make and post
You keep ownership of the games, art, sound, code, comments and other content you post on Maimbrain ("your content"). By posting it, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, run, display, adapt (for example, resizing an icon or making a preview) and distribute it, to promote Maimbrain with it, and to let other people use it on Maimbrain as Maimbrain allows. This license lasts as long as your content is on Maimbrain, plus a reasonable time to remove copies, and survives for content others have already remixed.
A game's code ships with the game and is visible to other people. If your game allows remixing (the default, set in its manifest), you also let other Maimbrain creators copy, change and publish remixes of it on Maimbrain.
You promise that you have the rights to everything you post, including art, music, sound, fonts and code made by other people or by AI tools, and that posting it doesn't break the law or anyone's rights.
We review games before they're listed and may remove, refuse or stop showing any content at any time, for any reason, without notice. We're not responsible for content other people post, and we don't endorse it.
Rules
Don't use Maimbrain to:
- post anything illegal, or that sexualizes minors, promotes violence against people, harasses or threatens anyone, or attacks people for who they are;
- post sexually explicit content, graphic gore, or content meant to shock;
- infringe anyone's copyright, trademark or other rights, including by using well-known characters, franchises or brands you don't have rights to;
- impersonate anyone, mislead people, or spam;
- collect other people's information, or track them;
- make games that try to escape the game sandbox, attack devices or Maimbrain, mine cryptocurrency, or hide what they do from review;
- cheat leaderboards, fake plays, likes or followers, or game Maimbrain's rankings;
- scrape, overload, probe or break into Maimbrain, or get around its limits or bans;
- misuse Maimbrain's creator AI tools (below).
We may remove content, limit features, or suspend or close accounts that break these rules or that we believe harm Maimbrain or its users.
Creator AI tools
We may give some creators access to image, music, sound-effect and 3D model generation paid for by Maimbrain. Access is a privilege we can change, limit or take away at any time, and it comes with a budget. Use it only for your Maimbrain games, and never to imitate well-known characters, franchises, brands or real people. Prompts are sent to the providers that do the generating (see the Privacy Policy), whose terms also apply. Generated output may resemble other work; you're responsible for checking that you can use what you generate.
Copyright complaints
If you believe something on Maimbrain infringes your copyright, email privacy@maimbrain.com with: what the work is; where on Maimbrain the infringing material is (a link); your contact details; a statement that you believe in good faith the use isn't authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are, or are authorized to act for, the owner, with your physical or electronic signature. We'll remove material when appropriate and close the accounts of repeat infringers. If your content was removed and you believe that was a mistake, write to the same address.
Our stuff
Maimbrain itself (its software, design, name and logo) belongs to us. These terms don't give you any right to it beyond using Maimbrain as offered. You may use the SDK, templates, starter kits and the mb tool we provide to make games for Maimbrain, and the games you make with them are your content. If you send us feedback or ideas, we may use them without owing you anything.
Leaving
You can stop using Maimbrain and delete your account at any time. We may suspend or close your account if you break these terms, if we have to by law, or if we stop offering Maimbrain. The sections on your content's license (for content already remixed), disclaimers, limits of liability, indemnity and the rest of the general terms survive.
Disclaimers
MAIMBRAIN IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We don't promise that Maimbrain will be available, secure, error-free, or that any content (including games made by other people) is accurate, safe or appropriate. Games may use flashing lights, motion and sound: stop playing if you feel unwell.
Limits of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL OR CONTENT, ARISING FROM OR RELATED TO MAIMBRAIN OR THESE TERMS, HOWEVER CAUSED AND EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO MAIMBRAIN OR THESE TERMS IS LIMITED TO THE GREATER OF FIFTY US DOLLARS ($50) OR WHAT YOU PAID US TO USE MAIMBRAIN IN THE 12 MONTHS BEFORE THE CLAIM. Some places don't allow these limits, so they may not all apply to you; where that's the case, they apply as far as the law allows.
Indemnity
If someone brings a claim against us because of your content or your use of Maimbrain in breach of these terms or the law, you agree to cover our reasonable losses and costs from it, as far as the law allows.
General
We may change these terms. We'll post changes here and update the date above, and tell you in the app or by email before significant changes take effect. If you keep using Maimbrain after that, you accept the new terms. If any part of these terms can't be enforced, the rest still applies. Not enforcing a part isn't giving it up. You can't transfer these terms; we can, for example to a company formed to run Maimbrain. These terms and the Privacy Policy are the whole agreement between us about Maimbrain.
Apple isn't a party to these terms and isn't responsible for Maimbrain or its content; Apple's own terms also apply when you get the app through Apple.
